We speak ofCSAM when it concerns an image or video of a child (someone under the age of 18) performing sexual acts. It does not necessarily require coercion or unwillingness too classify an image or video as CSAM. Even if the sexual acts are recorded with the consent of the child, it is a case of CSAM. Child sexual abuse material also occurs if there is sexual posing or if the child is in a sexually explicit environment.
Images or videos are punishable when there is an explicit sexual posing, when sexual acts are shown, or when a child is in a pose or environment with a clear sexual intent. This can also include virtual material, especially if it cannot be distinguished from real material.
Nudist images of minors are not punishable. But only if they are recorded in the child's home or in a safe, not unnatural environment where naturism and nudism are normal.
When an adult approaches a child with sexual requests via (social) media such as Snapchat or WhatsApp, we are also talking about CSAM. After all, this concerns videotaped sexual activities with children.
